Regulatory Public Notices

As used by the Corps, the term "public notice" is an official, required government announcement of a proposed agency action, decision made or under consideration, public hearing or other activity.  Please download the attachment(s) associated with notice for the complete, formatted, public notice with tables, illustrations, maps and plans.

    Expiration date: 6/24/2013

    The Wilmington District, Corps of Engineers (Corps) has received an application from The North Carolina Department of Transportation (NCDOT), seeking Department of the Army (DA) authorization to permanently impact 7,717 linear feet of jurisdictional stream channel, temporarily impact 438 linear feet of jurisdictional stream channel, permanently impact 6.13 acres of adjacent wetlands and temporary impact 0.80 acre of adjacent wetlands. There will also be 4.3 acres of wetland impacts due the hand clearing. These impacts are associated with the proposed construction of a section of the Greensboro Western Loop from north of SR 2176 (Bryan Boulevard) to SR 2303 (Lawndale Drive) in Greensboro, Guilford County, North Carolina. The project is proposed to be a six-lane divided facility on new location and totals 4.8 miles in length. This project is referred to as Transportation Improvement Project (TIP) U-2524CD. Section C of this project begins immediately north of SR 2176 (Bryan Boulevard) and terminates immediately east of US220 (Battleground Avenue) and Section D begins immediately east of Battleground Avenue and ends at SR 2303 (Lawndale Drive). Permit Drawings of the proposed project have been prepared based on final design for U-2524C and preliminary design for U-2524D.

    The Wilmington District, Corps of Engineers (Corps) has received an application from the North Carolina Department of Transportation (NCDOT) seeking Department of the Army authorization to permanently impact 2538 linear feet of jurisdictional stream channel, an additional 150 linear feet of temporary stream channel impact, permanently impact 0.82 acre of jurisdictional wetlands, and 0.04 acre of open water impact , associated with the proposed widening of SR 1003 (North Main Street) and SR 1820 (Skeet Club Road) to a multi-lane facility from US 311 to NC 68 in High Point, Guilford County, North Carolina. The NCDOT has identified this project as TIP U-3615.

    The Wilmington District, Corps of Engineers (Corps) issued a Public Notice on January 30, 2013, concerning an application received from Mr. Marc Hamel of the North Carolina Department of Transportation Rail Division (NCDOT Rails), seeking a Department of the Army permit authorization for permanent impacts to 1154 linear feet of jurisdictional stream channels and 3.48 acres of jurisdictional wetlands adjacent to Jimmy’s Creek which is a tributary of the Yadkin River, associated with the proposed safety improvements to approximately 4.2 miles of existing rail corridor located south of Bower Station to Lake Station, south of Thomasville, in Davidson County, North Carolina. The NCDOT Rails has identified this project as TIP Project C-4901A, D. Subsequent to comments and review of the referenced Public Notice, it was discovered the calculation of impacts to jurisdictional stream channels had a discrepancy between totals determined by a gps-delineation file survey compared to the modeled and surveyed stream channel boundaries. The more detailed modeled and surveyed stream channel boundaries resulted in the determination of an additional 91 linear feet of permanent impacts to jurisdictional stream channels (revised total permanent impact to jurisdictional stream channel is 1245 linear feet). Attached is revised plans and impact summary table for the project. The foot-print of the project has not change, but attached documents include a more detailed summary of impacts to jurisdictional waters. The purpose of this Public Notice is to identify discrepancy in the impact summary to jurisdictional stream channels and offer an opportunity to comment to commenting agencies.

    The Wilmington District, Corps of (Corps) issued a Public Notice on February 19, 2013, concerning an application received from the North Carolina Department of Transportation (NCDOT) regarding a potential future requirement for Department of the Army (DA) authorization to discharge dredged or fill material into waters of the United States associated with the proposed improvements and widening of I-85 and interchange improvements from north of NC73 in Cabarrus County to the US 29-601 Connector in Rowan County, North Carolina. Subsequent to comments and review of the referenced Public Notice, it was discovered the initial Public Notice contained an error with reference to the National Environmental Policy Act of 1969 (NEPA) document being prepared by the Federal Highway Administration (FHWA) for the project. The initial Public Notice stated that the FHWA in compliance with NEPA processing was evaluating project alternatives for the project through an Environmental Assessment (EA). The statement was incorrect in that FHWA is conducting their NEPA process review by processing a Categorical Exclusion (CE) document for the proposed project. The purpose of this Public Notice is to identify this error and offer an opportunity to comment for commenting agencies.
