As used by the Corps, the term "public notice" is an official, required government announcement of a proposed agency action, decision made or under consideration, public hearing or other activity.  Please download the attachment(s) associated with notice for the complete, formatted, public notice with tables, illustrations, maps and plans.

    The Wilmington District, Corps of Engineers (Corps) received an application from Publix Super Markets, Inc. and the North Carolina Department of Transportation (NCDOT) seeking Department of the Army authorization to discharge dredged or fill material into a total of 4,800 linear feet of stream channel, 0.91 acre of riparian non-riverine wetlands, and 1.8 acres of open water impoundments, associated with developing a grocery distribution center in Guilford County, North Carolina.

  • Special Public Notice - CLEAN WATER ACT PROPOSED RULE

    CLEAN WATER ACT PROPOSED RULE FOR A REVISED DEFINITION OF THE “WATERS OF THE U.S.” On February 14, 2019, the U.S. Environmental Protection Agency (EPA) and the Department of the Army (Army) published for public comment a proposed rule revising the definition of “waters of the United States,” which would establish the scope of federal regulatory authority under the Clean Water Act (CWA). The proposed rule is intended to satisfy the requirements of Executive Order (EO) 13778 that directed the EPA and the Army to review and rescind or replace the 2015 Clean Water Rule (80 FR 37053) and consider interpreting the scope of “waters of the United States” consistent with the Justice Scalia opinion (plurality standard) from Rapanos v. United States (2006). The EO instructed that any new proposed rule shall ensure that the Nation’s navigable waters are kept free from pollution, while at the same time promoting economic growth, minimizing regulatory uncertainty, and showing due regard for the roles of the Congress and the States under the Constitution.

    The Wilmington District, Corps of Engineers (Corps) received an application from the North Carolina Department of Transportation, Rail Division, seeking Department of the Army authorization to permanently fill 427 linear feet of perennial stream channel and 0.17 acres of surface water (Streams A and C), and to excavate less than 0.01 acres of wetland, for the construction of 2,500 linear feet of new connector track, at the Charlotte Wye, between the Norfolk Southern Railroad (NS), Atlanta to Washington D.C. mainline and the NS R-line. The project also includes associated rail improvements and intersection improvements, on/near Seymour Drive, in Charlotte, Mecklenburg County, North Carolina.

    The Wilmington District, Corps of Engineers (Corps) has received an application from the North Carolina Department of Transportation (NCDOT) seeking Department of the Army (DA) authorization to discharge dredged or fill material into waters of the United States associated with the proposed widen US 321 to a six lane median divided facility from just north of the US 70 interchange in Hickory (Catawba County) to the Southwest Boulevard (SR 1933) interchange in Lenoir (Caldwell County), North Carolina [State Transportation Improvement Program (STIP) Number U-4700].

The Wilmington District, Corps of Engineers (Corps or USACE) received an application from Mr. Steven DeFrancis of Kenjack Farms, LLC, (Kenjack Farms) seeking Department of the Army authorization for 1.9 acres of permanent wetland impacts (fill, grading, and conversion) associated with the construction of a 2.1 acre private amenity pond at 1749 Yellow Mountian Road in Cashiers, Jackson County, North Carolina.
