Regulatory Public Notices

As used by the Corps, the term "public notice" is an official, required government announcement of a proposed agency action, decision made or under consideration, public hearing or other activity.  Please download the attachment(s) associated with notice for the complete, formatted, public notice with tables, illustrations, maps and plans. Mitigation Public Notices

For all public notices pertaining to compensatory mitigation bank proposals or in-lieu fee mitigation sites developed by the North Carolina Division of Mitigation Services (NCDMS), please go to the Regulatory In-lieu Fee and Bank Information Tracking System website at https://ribits.usace.army.mil.

Workload Management Public Notice - 9/27/2018: Due to a demanding and very large daily workload, Regulatory Field Staff may be unable to schedule field visits in less than 30-90 days for the purpose of determining the presence of waters and wetlands subject to the U.S. Army Corps of Engineers regulatory jurisdiction pursuant to Section 404 of the Clean Water Act.

SAW-2018-01494 - 9/6/2018: The Wilmington District, Corps of Engineers (Corps) has received an application from Dream Catcher Hotels/Harrah’s Cherokee Casino Resort, on behalf of the Tribal Casino Gaming Enterprise, seeking Department of the Army authorization to permanently impact 0.022 acre of wetland and temporarily impact 45 linear feet of stream in order to expand Harrah’s Casino Resort on Qualla Boundary, Jackson County, North Carolina. The applicant also seeks after-the-fact authorization for impacts to 0.961 acre of on-site wetlands.

SAW-2018-01536 - 9/4/2018: The DISTRICT ENGINEER, WILMINGTON DISTRICT, hereby proposes to authorize Regional General Permit 201801536 pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C 403) and Section 404 of the Clean Water Act (33 U.S.C 1344). The general permit authorizes the construction, maintenance and repair of marsh sills for shoreline stabilization along eroding shorelines within waters located within the 20 coastal counties of North Carolina and subject to regulatory jurisdiction of the Wilmington District, Corps of Engineers. Title 33, Code of Federal Regulations (CFR), Paragraph 325, authorizes issuance of general (regional) permits for activities, which are substantially similar in nature and cause minimal individual and cumulative environmental impacts. SAW-2017-01312 - 8/24/2018: The Wilmington District, Corps of Engineers (Corps) received an application from the Airport Commission of Forsyth County seeking Department of the Army authorization to impact approximately 1.13 acres of wetland and 4,079 linear feet of jurisdictional stream channel associated with the following: 1) Extension of Taxilane L and new maintenance, repair, and overhaul (MRO) facilities; 2) MRO auto parking and apron expansion; 3) Runway 15-33 obstruction removal; 4) Runway 22 safety area extension; 5) New haul road; and 6) Construction of an erosion control/stormwater basin for the Smith Reynolds Airport in Forsyth County, North Carolina.

SAW-2011-00181 - 8/10/2018: The Wilmington District, Corps of Engineers (Corps) received an application on July 31, 2018, from Duke Energy (Applicant) seeking to modify the existing Department of the Army (DA) authorization for the Mayo Coal Combustion Product (CCP) Monofill Site – Phase 1. The existing permit authorized permanent impacts to 2,074 linear feet (lf) of stream channel for the construction of a synthetically-lined industrial landfill (Coal Combustion Product Monofill) and associated infrastructure at the Mayo Plant in Person County, North Carolina. This authorization was issued on August 22, 2012, and will expire on December 31, 2030. The Applicant requests to modify the existing DA authorization to permanently impact an additional 1.15 acres of wetlands and 227 lf of stream channel for the construction of a Lined Retention Basin (LRB) and for the Ash Basin Closure project at the Mayo Plant. Note that impacts associated with the LRB have already occurred and that the Applicant is requesting an after-the-fact permit modification for the impacts associated with the construction of the LRB.
