  • SAW-2022-00462 -Tamarack Land Development Middle Creek Village Subdivision

    The Wilmington District of the U.S. Army Corps of Engineers (Corps) has received an application for a Department of the Army permit pursuant to Section 404 of the Clean Water Act (33 U.S.C. §1344). The purpose of this public notice is to solicit comments from the public regarding the the following: The applicant is proposing to extend Middle Creek Drive in order to facilitate Phase IV of Middle Creek Village Subdivision. Authorization is requested to fill 0.25 acres of head water wetlands for the construction a road crossing extension, which will also contain a sidewalk and utilities to support Phase IV. The project is Phase IV of a phased development. Phase I of the project is complete, while Phases II and III are currently under construction with all approved impacts finalized. On August 25, 2022, a Nationwide Permit (NWP) 29 was obtained for the first phase of the project, allowing for impacts to 0.45-acre of jurisdictional 404 wetlands and 233 linear feet (0.044-acre) of stream impact (total impact of 0.494-acre). Due to project modifications, a second NWP 29 was issued to show a reduction in originally authorized impacts to 0.461-acre as well as authorize an additional 0.037-acre of permanent impacts and 0.01-acre of temporary impacts for Phase III. Total impacts for Phases I-III are currently 0.487 acres which includes 0.044 acres of stream impacts.

  • NAO-2018-1574 (VMRC-25-0752) (Norfolk District) / SAW-2018-00887 (Wilmington District) Mountain Valley Pipeline-South Gate

    CORRECTION – A correction is being issued for this public notice. The mitigation statement regarding stream mitigation in North Carolina has been amended to show that the applicant is proposing to mitigate for impacts to streams in the Wilmington District area of responsibility by purchasing credits at a 1 to 1 ratio from the from North Carolina Division of Mitigation Services In-Lieu Fee Program. This correction in the Compensatory Mitigation section has been shown in red text. The purpose of this notice is to advise the public that the following request associated with Mountain Valley Pipeline – South Gate project has been submitted for a Department of the Army (DA) permit under the provisions of, Section 404 of the Clean Water Act. The U.S. Army Corps of Engineers (Corps), Wilmington District has found that this permit request meets the terms of EO 14156 and is therefore subject to special emergency permitting procedures to address an energy supply situation which would result in an unacceptable hazard to life, a significant loss of property, or an immediate, unforeseen, and significant economic hardship if corrective action requiring a permit is not undertaken within a time period less than the normal time needed to process the application under standard procedures. The applicant requests authorization from the Norfolk District and the Wilmington District to construct 31.3 miles of 30-inch diameter natural gas pipeline to transport natural gas from an interconnection point with the Mountain Valley Pipeline in Pittsylvania County, Virginia to an interconnection point with the East Tennessee Natural Gas, LLC system (East Tennessee) in Rockingham North Carolina, and then to two new delivery points in Rockingham County, North Carolina. The overall proposed project would result in the permanent discharge of dredged and/or fill material into 114 linear feet (0.0093 acre) of streams, the temporary discharge into 6,417 linear feet (0.785 acre) of streams and 8.1535 acres of wetlands, and the permanent conversion of 8.8971 acres of forested and scrub-shrub wetlands to emergent wetlands.

  • SAW-2024-01774 (King Asphalt, Inc-Asphalt Plant, Brunswick County)

    The Wilmington District of the U.S. Army Corps of Engineers (Corps) has received an application for a Department of the Army permit pursuant to Section 404 of the Clean Water Act (33 U.S.C. §1344). The purpose of this public notice is to solicit comments from the public regarding the following proposed work: The applicant requests authorization to fill 1.280 acres of wetlands for the construction of aggregate storage yard for the proposed asphalt plant. The facility includes the construction of offices, mixing plant structure, access roads, storage area, and stormwater features.

  • Emergency Permit Application Processing Procedures for Activities Subject to Executive Order 14156 (National Energy Emergency)

    The purpose of this notice is to advise the public that the United States (U.S.) Army Corps of Engineers, Wilmington District has established special emergency processing procedures in accordance with 33 CFR § 325.2(e)(4) for the National Energy Emergency established by Executive Order (E.O.) 14156, which was issued on January 20, 2025, under the President’s legal authorities, including the National Emergencies Act (50 U.S.C. 1601 et seq) and section 301 of title 3, United States code. These special emergency processing procedures have been established in accordance with Sec. 4 of 14156 for activities associated with the identification, siting, production, transportation, refining, and generation of domestic energy sources, including energy infrastructure, that require Department of the Army authorization under Section 10 of the Rivers and Harbors Act of 1899, Section 404 of the Clean Water Act, 33 USC §408 (Section 408), and/or Section 103 of the Marine Research, Protection, and Sanctuaries Act of 1972, as amended. For the reasons stated in Sec. 1 of EO 14156, the President has found that these activities would result in an unacceptable hazard to life, a significant loss of property, or an immediate, unforeseen, and significant economic hardship if corrective action requiring a permit is not undertaken within a time period less than the normal time needed to process the application under standard permitting procedures. These alternate procedures will be utilized until EO 14156 is rescinded.

  • Ten (10) Eastern North Carolina Aquatic Species Standard Operating Procedures for Endangered Species (SLOPES)

    The purpose of this public notice is to announce that the Wilmington District, U.S. Army Corps of Engineers (USACE), and the United States Fish and Wildlife Service (Service) have developed a SLOPES agreement concerning potential effects to ten (10) aquatic species in Eastern North Carolina that are federally listed or proposed for listing. The nine (9) listed species are: Atlantic Pigtoe (Fusconaia masoni), Dwarf Wedgemussel (Alasmidonta heterodon), Tar River Spinymussel (Parvaspina steinstansana), Yellow Lance (Elliptio lanceolata), James Spinymussel (Parvaspina collina), Roanoke Logperch (Percina rex), Cape Fear Shiner (Notropis mekistocholas), Carolina Madtom (Noturus furiosus), Neuse River Waterdog (Necturus lewisi). The one proposed species is the Green Floater (Lasmigona subviridis).
