This Public Notice is being issued to acknowledge that the Wilmington District Regulatory Division (District) was requested by the North Carolina Department of Transportation (NCDOT) to issue an emergency (Section 404 of the Clean Act and Section 10 of the Rivers and Harbors Act) permit to place, via pipe line dredge, 30,000 cubic yards of sand adjacent to the Herbert C. Bonner Bridge at Bent #166, Oregon Inlet, Dare County, North Carolina. On December 3, 2013, NCDOT closed Herbert C. Bonner Bridge because of safety concerns due to erosion and scouring around Bent #166. The NCDOT proposed this project in order to place sand material at this location to fill in the scour hole and stabilize the bridge.

Pursuant to 33 CFR 325.2(e)(4), Brigadier General Donald E. Jackson, Commander of South Atlantic Division, U.S. Army Corps of Engineers authorized Colonel Steven A. Baker, Commander of the Wilmington District, to issue an emergency permit to NCDOT for this proposal on December 5, 2013. A subsequent modification to the original authorized emergency permit was also authorized later on December 5, 2013, to allow for more effective placement of sand into the scour area (see attached plans). Before issuing the emergency permit the Wilmington District contacted and coordinated with resource agencies to address environmental concerns. As stipulated by emergency permitting regulations the District will complete all environmental assessments and documentation required by the National Environmental Policy Act. Due to the dynamic nature of this situation additional modifications to the December 5, 2013 emergency permit may be required.

Written comments pertinent to the proposed work, as outlined above, will be received by the Corps of Engineers, Wilmington District, until 5pm, December 23, 2013. Comments should be submitted to Tracey Wheeler, 2407 West Fifth Street, Washington, NC 27889.
