The Wilmington District, Corps of Engineers (Corps) received notice from AFFP, LLC of their intentions to modify the previously approved Mitigation Banking Instrument (MBI) for the Anderson Farm Stream Mitigation Bank (Bank). This mitigation bank site is located in Buncombe County, North Carolina with the Upper French Broad (HUC 06010105) as its geographic service area. The Bank was originally approved and authorized to sell warm water stream mitigation credits on June 25, 2013. However, due to an oversight in the review process, it has come to the Corps’ and the sponsor’s attention that the warm water stream classification for the site was incorrect. The sponsor is requesting to change the MBI to only allow the sale of cool water credits which is the stream type present on the mitigation site. The geographic service area, the Upper French Broad, is comprised of both cool and cold water stream systems.

The Corps of Engineers, Wilmington District will receive written comments pertinent to the proposed modification, as outlined above, until 5pm, Friday, February 14th, 2014.
