This web site provides information on the Corps of Engineers Wilmington District's Regulatory program. 10/30/2009 - The Wilmington District Corps regulatory program seeks comments investigating the use of web interface tools to enhance our web site to assist in educating stakeholders about the requirements and processes related to obtaining a Corps permit. Public Notice

9/14/2009 - The recently revised Commander's Policy #5 for Water setback along Federally Authorized Waterways (revised 7/21/2009) is posted in our library on the Wilmington District Program Policy and Guidance page.

8/19/2009 - Did you know that the Regulatory program in the Wilmington District publishes permits issued each month?

8/19/2009 - The Wilmington District regulatory program  received approximately $200,000 in stimulus (i.e., Recovery, ARRA) funds to assist in the conversion of our regulatory file system from paper to digital.  The Government Printing Office will be providing contract support to the program for this effort.  The Wilmington District has paper records of permits, other regulatory actions, and navigational studies that date back over 100 years.  In the last ten years alone, the District regulatory program accumulated well over a million pages of required documents, reports, maps and plans for over 50,000 completed activities.  The Recovery Act funds will help the District in its plans to transition to an all-digital system, ultimately saving processing time and reducing the costs of storage and retrieval of paper files.

8/13/2009 - The Federal Register announcing the proposed suspension and modification of NWP 21 was scheduled to expire on August 14, 2009. We have received numerous requests that the comment period be extended. Based on an evaluation of the requests, we have determined that a 30 day extension is warranted. The Federal Register announcing extension of the comment period to September 14, 2009 was published today.

7/20/2009 - HQ Regulatory revised the standard operating procedures to reflect changes in the program over the last several years.  This document is posted in the National Program Policy and Guidance page of our regulatory library.

7/15/2009 - The US Army Corps of Engineers (Corps) published a proposal in the Federal Register to suspend and modify Nationwide Permit (NWP) 21 which authorizes discharges of dredged or fill material into waters of the United States for surface coal mining activities. This is a national program proposal.  Nationwide Permit 21 has not been used in the Wilmington District. 

Public Notice - Federal Register (Vol. 74, No. 134 / Wednesday, July 15, 2009 / Notices p. 34311)  Comments will be received until August 14, 2009 (see the Federal Register Notice for instructions).

4/30/2009 - The Washington Field Office has moved.  The new address for the Washington Field Office:

DID YOU KNOW ...

The acreage, variety and complexity of waters and wetlands in North Carolina make this one of the largest areas and most diverse variety of wetlands found in the United States.   The Wilmington District Regulatory jurisdictional area includes approximately 8.5 million acres of waters and wetlands in North Carolina, ranging from coastal marshes and waters to wooded swamps, pocosins, bottomland hardwoods, mountain bogs, and trout waters. 


Many land areas in North Carolina, especially in the coastal counties, have regulated wetlands or waters on them. Prospective lot purchasers, developers, and their real estate agents and attorneys, should have the property checked for the presence of wetlands prior to purchase or before beginning any construction or land clearing activity. If you suspect either jurisdictional waters or wetlands exist on your property, it is recommended that you have a jurisdictional determination (JD) completed prior to undertaking any work such as filling, excavating or land clearing. Ellerbe CreekSince 1890, the US Army Corps of Engineers regulated activities in the nation's waterways. Until the 1960's, the primary purpose of the regulatory program was protection of the waterways for navigation.  Since then, as a result of laws and court decisions, the scope of the program expanded and changed to reflect current policy.  It now considers the full public interest for both the environmental protection and uses of the nation's water resources.
